Intellectual Property and Content Ownership

By submitting content, you represent and warrant that you own or control all necessary rights to that content (including any intellectual property rights), and that the content is accurate to the best of your knowledge, and use of the content on our Site will not violate any third-party rights or laws.

  1. License Grant to Us: By posting or submitting any content on or through our Site, you hereby grant DIY Homeowners and our affiliates and designees a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, adapt, modify, create derivative works of, publicly perform, publicly display, and otherwise exploit your User-Submitted Content, in any media now known or hereafter developed. This license is necessary for us to operate the Site (for example, to display your comments on an article, or to include your feedback in future content). It also allows us to promote the Site and our content, which may include featuring your contributions. You understand that you will not be paid for our use of content you submit.

For example, if you leave a comment reviewing your experience with a home insurance provider, you give us the right to quote or reference that comment later in an article about user experiences, and to keep the comment displayed on the Site indefinitely. If you email us suggestions or ideas to improve our Site or services, you give us permission to implement and use those ideas freely, without any obligation to you.

  1. No Endorsement: User-Submitted Content reflects the personal opinions of the individuals who post it, not the opinion of DIY Homeowners. We do not endorse, guarantee, or necessarily agree with any user content. We are not liable for any statements, representations, or omissions made in user content. If you choose to rely on any information or opinions expressed in User-Submitted Content, you do so at your own risk.
  2. Moderation and Removal: DIY Homeowners reserves the right (but has no obligation) to monitor, review, edit, or remove User-Submitted Content at our sole discretion at any time and for any reason, without notice. We may remove content that we believe violates these Terms or is otherwise objectionable. We may also disable or restrict your ability to submit content if you violate these Terms. However, we are not responsible if we fail to remove specific content or for any delay in removing content. If you become aware of content that violates these Terms or is otherwise inappropriate, please notify us. We will investigate such reports, but we do not guarantee any particular action or response.
  3. Ownership: Except for the license you grant us above, you retain all ownership rights in the original content you submit (to the extent you had such rights to begin with). We do not claim ownership of your ideas, posts, or comments. If you delete or remove your User-Submitted Content from the Site, our license to that content will generally end after a reasonable period necessary for full removal from our systems, except that you acknowledge we may retain archived or backup copies of your content (and we will continue to have rights to those copies, to the extent they are retained), and we may retain and continue to use any content that has been incorporated into other materials (for example, if your comment was included in an article or quoted, we may continue to use that article or quote).

By submitting any content, you also agree to abide by any community guidelines or rules for user conduct that we may post on the Site (such as forum rules or commenting guidelines), which are incorporated into these Terms. These guidelines may provide more specific details on acceptable content and behavior.

Acceptable Use and Prohibited Activities

You agree to use DIY Homeowners and the Site only for lawful purposes and in accordance with these Terms. You must not misuse the Site or any Content. Below are specific examples of prohibited activities and uses; this list is not exhaustive, and it is intended to provide examples of conduct that is not allowed:

  • No Illegal, Harmful, or Abusive Use: You may not use the Site to violate any law, regulation, or ordinance, or for any fraudulent or malicious purposes. This means you will not use the Site to engage in any unlawful activity, to plan or encourage others to commit illegal acts, or in connection with any defamatory, harassing, abusive, or otherwise harmful communication. You agree not to upload or transmit any content through the Site that is illegal, offensive, or could create civil liability for us or for other users.
  • No Violation of Others’ Rights: You must not use the Site to violate the rights of any other person or entity. This includes not infringing or misappropriating intellectual property rights (copyright, trademark, patent, trade secret) of others and not violating privacy or publicity rights of others.   • No Automated Access, Scraping, or Data Harvesting: You may not use any robot, spider, scraper, crawler, script, or other automated device, process, or means to access the Site or to retrieve, index, “data mine,” or in any way gather Content or information from the Site for any purpose without our express prior written consent. This includes prohibiting any automated or systematic extraction of data or Content, whether to create a collection, compilation, database, or directory, or for any purposes of machine learning or AI development (as noted in the Intellectual Property section above). You agree not to scrape or harvest Content from the Site for use in any artificial intelligence or machine learning training set or algorithmic model.
    The only exception to the foregoing automated access rule is that we grant permission to bona fide public search engines (e.g., Google, Bing, etc.) and public archives to use spiders to index Content from the Site for the sole purpose of creating publicly available searchable indices (or archives) of the materials, and not for any commercial purpose or to cache or store the materials. We reserve the right to revoke this exception at any time either generally or in specific cases. Additionally, if our robots.txt file indicates any portions of the Site are off-limits to indexing, you must respect those instructions.
  • No Framing or Misrepresentation: You will not frame, mirror, or otherwise incorporate any portion of the Site into any other website or service. You agree not to impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity in connection with your use of the Site. You also agree not to use the Site in a manner that suggests an unauthorized association or is likely to cause confusion between you (or your organization) and DIY Homeowners.
  • No Unauthorized Advertising or Commercial Use: You may not use the Site to advertise or promote products or services other than those offered by DIY Homeowners, without our express permission. This means you will not post unauthorized commercial communications (such as spam, promotional materials, or any junk mail) on the Site. You may also not use any Contact information or user information obtained from the Site to contact other users for any commercial purposes outside of the Site’s intended use.

We reserve the right to investigate any suspected breaches of this section or misuse of the Site and to cooperate with law enforcement in prosecuting users involved in violations of this section. Your permission to use the Site is conditioned upon your compliance with the above restrictions, and any violation may result in termination or suspension of your access to the Site as described in the Termination section below, as well as potential legal action against you.

Disclaimer of Warranties

Use At Your Own Risk: DIY HOMEOWNERS PROVIDES THE SITE AND ALL CONTENT ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Your use of the Site, the Content, and any services or items obtained through the Site is at your own risk. To the maximum extent permitted under applicable law, DIY Homeowners (including our affiliates, and our and their respective directors, officers, employees, and agents) disclaims all warranties of any kind, whether express or implied, in connection with the Site and your use of it. This includes, but is not limited to:

  • Implied Warranties: We disclaim all implied warranties such as merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. We make no guarantee that the Site or Content is suitable for your needs, will meet your expectations, or will achieve any particular results.
  • No Warranty of Accuracy or Reliability: While we strive to provide useful and accurate information, we do not warrant or guarantee the completeness, timeliness, correctness, or accuracy of any Content. Limitation of Liability

To the fullest extent permitted by law, in no event will DIY Homeowners, its parent company, affiliates, or their respective employees, officers, directors, contractors, licensors, agents, or representatives, be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of (or inability to use) the Site or any Content or services provided on or through the Site. This includes, without limitation, damages for lost profits, lost savings, lost or corrupted data, loss of goodwill, business interruption, or any other intangible losses, even if we or any authorized representative has been advised of the possibility of such damages.

DIY Homeowners’ liability to you for any direct damages or any form of relief whatsoever (whether in contract, tort, negligence, strict liability or any other legal or equitable theory) arising out of or relating to these Terms, the Site, or the Content will be limited to the amount (if any) that you paid to us to use the Site in the 12 months prior to the event giving rise to liability, or USD $100, whichever is greater. (For most users, this amount will be $0, since the Site is typically used for free.) If applicable law does not allow the limitation of liability as set forth above in certain circumstances, the above limitation may not apply to you and in such cases our liability will be limited to the smallest amount permitted by law.

No Liability for Third-Party Conduct: Under no circumstances will we be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Site or your information, or from the actions or content of any third parties. This means that if a third-party gains unauthorized access to our Site or to your data despite our security measures, or if you encounter harmful content posted by another user or a malicious actor, we are not liable for the consequences.

Because some states or jurisdictions do not allow exclusion or limitation of certain damages, the above limitation may not apply to you in its entirety. However, in such jurisdictions, our liability is limited to the greatest extent permitted by law.

You acknowledge and agree that the above disclaimers and limitations of liability are fundamental elements of the basis of the bargain between DIY Homeowners and you. The Site and Content would not be provided to you without such disclaimers and limitations.

Indemnification

You agree to indemnify, defend, and hold harmless DIY Homeowners, its parent company, affiliates, and their respective officers, directors, employees, agents, and representatives (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site or Content in violation of these Terms; (b) any User-Submitted Content you provide, or any other information or materials you submit, post, or transmit through the Site (including claims that such content infringes or misappropriates any third party’s intellectual property or privacy rights, or is defamatory or otherwise harmful); (c) your violation of any law or regulation or of any rights of a third party in connection with your use of the Site; or (d) your willful misconduct or negligence in using the Site.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in such case, you agree to cooperate with our defense of that claim. You agree not to settle any such matter without the prior written consent of DIY Homeowners. This indemnification provision remains in effect even after you cease using the Site or after termination of these Terms.

Termination of Access

Termination by Us: We reserve the right, in our sole discretion, to suspend or terminate your access to all or part of the Site at any time, with or without notice, for any reason or no reason, including (without limitation) if we believe you have violated these Terms or you are engaging in any conduct that we deem inappropriate or harmful. Because we do not require user accounts for general access, termination may consist of banning your IP address, blocking certain email addresses from our communications, or other measures to prevent your further use of the Site. We may also remove or delete any User-Submitted Content or other data associated with you. In the event of termination for a breach of these Terms, we may also pursue any other remedies available at law or in equity.

Termination by You: If you no longer wish to be bound by these Terms, you must stop using the Site entirely. You are free to cease using the Site at any time. If you have subscribed to any emails or newsletters, you may use the provided unsubscribe mechanism or contact us to cancel those subscriptions. If you have provided personal information for lead generation or other purposes and wish to withdraw consent or request deletion, please refer to our Privacy Policy for instructions on how to do so.

Effect of Termination: Upon any termination of your access, whether by you or us, your right to use the Site will immediately cease. The following provisions of these Terms will survive termination (meaning they will remain in effect even after termination of the agreement between us): Intellectual Property and Content Ownership, User-Submitted Content (to the extent of the licenses granted to us), Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Class Action Waiver, Limitation on Claims, and Miscellaneous, as well as any other provisions that by their nature should survive termination.

Termination of access or of these Terms will not affect any rights or obligations that have accrued prior to the termination. If your access is terminated due to a breach of these Terms, we reserve the right to refuse re-access or re-registration (if applicable) to the Site in the future.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to the Site or these Terms (including any non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without giving effect to any conflict of law principles that would cause the laws of another jurisdiction to apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Jurisdiction and Venue: You and DIY Homeowners agree that any judicial action or proceeding arising out of or related to these Terms or your use of the Site shall be brought in and subject to the exclusive jurisdiction of the state or federal courts located within the State of Delaware. You hereby consent to the personal jurisdiction of those courts and waive any objections on grounds of venue or inconvenient forum, provided that DIY Homeowners shall be entitled to seek injunctive or equitable relief in any jurisdiction to enforce these Terms or stop or prevent an infringement of intellectual property or other rights.

If you are accessing the Site from a location outside of the United States, you remain responsible for complying with all local laws. However, the governing law as stated above (Delaware) will still apply to these Terms and any disputes.

Class Action Waiver

You and DIY Homeowners agree that all disputes will be resolved on an individual basis and that you may bring claims against us only in your individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You expressly waive any right to file a class action or seek relief on a class or representative basis.

This means that neither you nor we shall be entitled to join or consolidate claims by or against others, or litigate any claims as a class action, as a private attorney-general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity. A court may award relief (including injunctive relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. If for any reason this class action waiver is found to be unenforceable or void, then any dispute will be resolved in court (not in arbitration) and will be subject to the exclusive jurisdiction of the Delaware courts as set forth above.

You understand that by agreeing to this class action waiver, you may only pursue claims against DIY Homeowners in an individual capacity, and you are giving up your right to participate in a class or representative action against us. This provision is an essential part of our agreement.

Limitation on Time to File Claims

Any claim or cause of action you may have arising out of or relating to these Terms or your use of the Site must be filed within one (1) year after such claim or cause of action arose; otherwise, it is permanently barred. To the extent the law of your jurisdiction allows a longer period, you agree that this one-year period shall still apply. This limitation period applies to all causes of action or claims you might have, whether based on contract, tort, statute, or any other legal theory.

In other words, if something occurs that gives rise to a potential claim by you against us, you must initiate legal proceedings within one year of that event or forever waive the claim. This section does not apply to DIY Homeowners’ claims for injunctive or equitable relief, which shall not be time-barred.

Miscellaneous Provisions

Entire Agreement: These Terms (including our Privacy Policy and any other documents or policies expressly incorporated by reference) constitute the entire agreement between you and DIY Homeowners regarding your use of the Site, and supersede any prior or contemporaneous understandings, agreements, representations, or warranties (whether oral or written) relating to the Site. Any additional or different terms proposed by you (for example, in any communication) are hereby objected to and rejected by us and will be of no force or effect.

Severability: If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. In other words, the invalid part will be severed and the rest of the Terms will remain valid and enforceable.

Waiver: No waiver by DIY Homeowners of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of that term or any other term, and any failure by DIY Homeowners to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. Our rights and remedies under these Terms are cumulative and not exclusive.

Assignment: DIY Homeowners may assign or transfer its rights and obligations under these Terms, in whole or in part, to any person or entity (for example, in connection with a merger, acquisition, sale of assets, or by operation of law) without notice to you or your consent. These Terms will inure to the benefit of our successors and assigns. You may not assign, delegate, or transfer any of your rights or obligations under these Terms without our prior written consent, and any attempt to do so without consent will be null and void.

Relationship of the Parties: You agree that no joint venture, partnership, employment, or agency relationship exists between you and DIY Homeowners as a result of these Terms or your use of the Site. You are an independent party. You also acknowledge that we are not your agent or fiduciary.

No Third-Party Beneficiaries: These Terms are for the benefit of you and DIY Homeowners (and our successors and assigns). Except as expressly provided in the Indemnification section above with respect to the Indemnified Parties, these Terms do not confer any rights or remedies on any third parties.

Headings: Section titles or headings in these Terms are for convenience only and have no legal or contractual effect.

Notices: We may provide notices or communications to you via email (if you have provided us with an email address), through postings on the Site, or by any other method we reasonably select. For notices we send by email, the notice will be effective as of the date the email is sent. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. If you need to give us official notice of any matter, you must do so in writing via email to the address provided below or via certified mail to our mailing address (if provided).
